Our Purchase Agreement and Health Guarantee

(This is a general contact we use and is subject to change without notice.)

1. The above said Border Collie is sold for the total price of $            . Ownership of the puppy/dog will be transferred to the Buyer for the sales price of $             to be paid as follows: $200.00 deposit on execution of the Agreement with the balance of $                 to be paid on or before the puppy/dog leaves the Seller’s premises.  If the balance in not paid by                                        , this Agreement shall be cancelled and the Buyer forfeits the deposit given hereunder.  The Buyer understands that once a deposit is made, the deposit in non-refundable if the desired sex of the puppy is available.  The deposit may be transferred to another litter.

$200.00 has been received as a deposit for one Border Collie from the above breeding.

2. The Seller will register the puppy with the American Border Collie Association, Inc., with a name provided by the buyer, starting with the letters “Eclps”, and provide the non-breeding registration papers to the Buyer.

3. If delivery is requested by Buyer, it shall be by airfreight, C.O. D, to a designated location it will be between eight (8) and nine (9) weeks old.  Buyer is responsible for costs of crate, insurance during shipment, and cost of freight charges.  If seller has to purchase a crate prior to shipping, Buyer shall reimburse Seller in full for this cost.  Puppies left past nine (9) weeks will be charged $50.00 per week for boarding and training.  The puppy will have its first set of shots and dewormed.  A shot record, pedigree and information will be provided.

 IT IS HEREBY AGREED BY BOTH PARTIES THAT THE FOLLOWING CONDITIONS WILL BE MET AND THAT NO OTHER WARRANTIES OR CONDITIONS ARE EXPRESSED OR IMPLIED. 

4. Seller guarantees this is a purebred Border Collie, offspring of the previously mentioned Sire and Dam.

5. BUYER certifies that he/she is not acting as an agent for another individual in the purchase of this dog, and will not sell this dog to any mass-producing kennel (puppy-mill) or business.                                                (Buyer’s Initials)

6. Buyer agrees the puppy will reside at the home of the Buyer and will be provided with proper housing, a good quality diet, annual shots and exercise. This includes vaccinations, heartworm preventative, and rabies followed by the recommendations of a licensed Veterinarian.  The dog shall not be kept permanently in a kennel.  Buyer also agrees this puppy/dog will not be used as a guard dog for any business.  If problems arise concerning keeping or training, or the dog becomes seriously ill, the BUYER agrees to consult the Breeder.  If at any time during the dog’s life, it is no longer wanted, the Breeder has first option to purchase the dog back at no more than “Half” of the original purchase price.  The Buyer pays the cost of shipping the dog back.  Selling to a third party is permissible only after prior consultation with the Breeder, whereby the main consideration is the assurance the dog is passed to responsible owners.  This puppy has been bred by us and has been carefully and painstakingly reared.  The parent animals were mated with the aim of breeding good and healthy puppies.                                (Buyers initials)

7. Seller warrants the above-described puppy/dog is in good health at the time Buyer assumes ownership. Buyer agrees to have the puppy examined by a licensed Veterinarian within two (2) days (not including weekends and holidays) of receipt of puppy/dog.  If, as a result of the examination, the licensed Veterinarian determines the puppy/dog is not in good health then the Buyer shall elect to keep the puppy/dog or return the puppy/dog to the Seller for a refund.  If the buyer elects to return the puppy, Buyer shall, within ten (10) days after the date of the signing of this contract, send to Seller by certified mail a written Veterinarian’s certificate stating the puppy/dog was in ill health when examined.  Upon receipt by Seller of said certificate, Buyer shall be obligated to return the puppy/dog to Sellers at Buyers expense.  Upon receipt of the puppy/dog, the Seller shall be obligated to refund all monies minus the deposit received from the Buyer toward the purchase price of the puppy/dog, and further performance under this contract shall be null and void.  All action taken to return the puppy/dog shall be done with the best interest of the puppy/dog in mind including; temperature at time of shipment and non-stop flights.

8. Seller warrants the puppy/dog sold hereunder is progeny of animals OFA Hips and Elbows normal and Eyes Certified.  If said puppy/dog develops any genetic defects within 30 (thirty) months from date of birth, the Buyer may return the dog to Seller and will receive a replacement puppy/dog of like quality from the next available litter, or may keep the dog, which will be spayed or neutered, and Seller will refund $300.00.  If Buyer chooses a replacement puppy/dog, Buyer and Seller shall make prompt arrangements within ten (10) days of receipt of certified letter and Veterinarian certification for return of the puppy/dog until Seller receives it.  Costs and related expenses of Veterinarian care and or returning the puppy/dog to Seller shall be the obligation of the Buyer.  The puppy must be Eye Certified yearly until the age of five (5) years and must have hips certified at the age of two (2) years.  The Breeder will be notified of the results.  This guarantee is null and void if said puppy has not received proper exercise, diet, has not been maintained properly for its size and weight, or has not been Eye Certified yearly until the age of five (5) years and had its hips certified by twenty-eight (28) months.

9. The Buyer agrees if this male or female was given full registration to be bred, the Border Collie it is bred with must be OFA certified (Hips) and Eye Cerfed normal.  Both must be great representations of the breed, both must have sound temperament, and working ability.                   (Buyers Initials)

10. In the case of the puppy being sold as a pet, the new owner will provide proof of spay/neuter by a licensed Veterinarian, by the age of eight (8) months. (DATE:                        ) Seller agrees to refund to the buyer the sum of $100.00 upon receipt of evidence from a licensed Veterinarian that the puppy/dog has been spayed/neutered.

11. No other warranties are expressed or implied unless by Seller below:

Buyer releases Seller, Eclipse (Eclps) Border Collies, and their estate from any and all liabilities, and/or damages by fault of this dog after the time of sale.  These damages include, but are not limited to, destruction of property and/or physical damage to any person or group of people. 

This contract is made out in duplicate; the Seller and Buyer each to receive one copy.
